Democrats in Congress want nearly 50 years in jail for Jared Kushner

Democrats in Congress are lining up a criminal theory against Jared Kushner that, on paper, adds up to nearly half a century in federal prison.

The charge they are building is not vague “ethics.” It is FARA — the Foreign Agents Registration Act. If you act on behalf of a foreign government in political or diplomatic matters without registering, it is a felony. Each count can carry up to five years. Stack the counts, and the number climbs fast.

That is the legal weapon ranking Democrats are reaching for.

The dual role

While serving as a top Trump Middle East envoy and negotiator — Special Envoy for Peace — Kushner’s private equity firm Affinity Partners has raised over $5 billion. Much of it came from the exact same Gulf governments he has been cutting deals with.Saudi Arabia’s Public Investment Fund alone put in $2 billion. The UAE and Qatar added hundreds of millions more.He has been deeply involved in:

• Gaza hostage negotiations
• Iran policy
• Regional deals

All while his firm is actively courting and managing money from those same countries.Conflict of interest? Democrats say it is textbook.

The paper trail they cite

Reporting in The New York Times laid out Affinity’s Mid-east fundraising while Kushner stayed inside the negotiating rooms. Democrats, including Sen. Ron Wyden and Rep. Jamie Raskin, have already sent formal letters and made Justice Department referrals.

They argue Kushner was simultaneously:

• Influencing U.S. policy toward Gulf nations
• Raising billions from those same nations

That is the core allegation.

Wyden and House Oversight Ranking Member Robert Garcia demanded answers from the White House and from Affinity after reports that Kushner was soliciting additional foreign capital while co-leading negotiations. Raskin opened a sweeping Judiciary inquiry calling the arrangement a “glaring and incurable conflict of interest” and later expanded it when records were not produced.They say the American people cannot know whose interests sit across the table when the envoy’s firm is paid by the monarchies at the table.

Why the sentence math exists

FARA is simple on the statute books and brutal in the stacking.

Act for a foreign principal in political or diplomatic work. Fail to register. That is a felony. Five years a count. Multiple meetings, multiple countries, multiple fundraising cycles — Democrats say that is how you get to “nearly 50 years” as a theoretical exposure, not a judge’s order that already exists.

No indictment has been unsealed. No jury has spoken. What exists today is letters, referrals, and a public case that Democrats intend to turn into compulsory process if they win a chamber.

The midterm trigger

Here is what makes this explosive:

If Democrats win the House or Senate in the 2026 midterms, they get full subpoena power.

More than 30 Democratic members of Congress have already signaled the plan: if they take a majority, they intend to investigate Jared Kushner for FARA violations.

That means calendars. Investor lists. Communications with Saudi, Emirati, and Qatari officials. The line between a fundraising pitch and a policy meeting.

Until then, they are in the minority. Letters can be ignored. Referrals can sit. After November, the file can move from press release to deposition.

Bigger than one name

This is not just about one guy.

It is about whether former — and current — officials can use their government influence to build massive private fortunes from foreign powers with zero transparency.

Kushner’s camp and the White House describe him as an unpaid volunteer whose private firm is separate from official work. They point to first-term dealmaking and say critics have not produced a document that proves a U.S. position was sold for a fund commitment.

Democrats say the overlap is the proof: same countries, same period, same man in the room and on the cap table.

The law they want applied does not require a signed invoice that says “policy for capital.” It requires a jury to believe he was acting as an agent of a foreign principal in political activity and did not register.

That fight is now on the calendar. The midterms decide whether it stays a thread — or becomes a case file.
