The Democratic National Committee filed a lawsuit Thursday against the Department of Justice, accusing the Trump administration of violating the Freedom of Information Act by failing to respond to requests for records about any plans to seize ballots or other election materials during the 2026 midterm elections.
The complaint, filed in the U.S. District Court for the District of Columbia, seeks documents related to any “planned, anticipated, or potential” inspection or seizure of election materials — including ballots, voting machines, and other voting system components — beginning 30 days before a federal election and continuing through certification of the results.
According to the DNC, the FOIA requests were submitted in February 2026. Nearly five months later, the committee says it has received no responsive records. The lawsuit asks the court to order the Justice Department to process and produce the materials.
“Donald Trump is historically unpopular and doing everything he can to subvert our elections this November — which is why we’re suing his administration once again,” DNC Chair Ken Martin said in a statement. “In our ongoing fight to protect free and fair elections, the DNC is holding Trump and his cronies accountable for their continued threats to our democracy. Whether in court or at the ballot box, we will stand with voters and defend them from Trump’s attempts to suppress their voices.”
The lawsuit follows the FBI’s January 2026 seizure of more than 600 boxes of records from the 2020 presidential election at the Fulton County Election Hub and Operation Center in Georgia. Those materials, which included physical ballots, were taken under a federal search warrant related to an investigation of the long-resolved 2020 contest.
In its complaint, the DNC argues that seizing cast ballots or voting equipment before an election is certified “would threaten the security, transparency, and ultimate validity of an election” and could violate voters’ First Amendment rights. The committee says it is seeking the records to determine whether the administration has considered similar actions timed around the upcoming midterms.
